Terms and Conditions of Use

The Corporation de services du Barreau du Québec (hereinafter "the Corporation") operates under license the website "juricarriere.com" (hereinafter the "Site"). The use of the Site is governed by the terms and conditions reproduced below, which constitute a contract between you and the Corporation. These terms and conditions may be modified by the Corporation at any time.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE SITE

By using the Site, you acknowledge that you have read and understood these terms and conditions, you agree to be bound by them and you undertake to comply with them. If you do not wish to be bound by these terms and conditions, do not access or use the Site.

1. TERMS OF USE

1.1 Site Operation Location

The Corporation operates the Site from its offices located in Montreal, in the province of Quebec, Canada. The Corporation makes no representation that elements of the Site may be used in locations other than Quebec, and it is prohibited to access the Site from territories where legislation would prescribe that the content or use of the Site is illegal or unlawful. Those who choose to use the Site do so on their own initiative and it is their responsibility to comply with all applicable local laws. Any claim relating to the Site and the elements it contains, or arising from the use of the Site, is governed by the applicable laws on the territory of the province of Quebec.

1.2 Usage Restrictions

You are authorized to download one (1) copy of the elements comprising the Site to your personal computer, via a web browser. Unless otherwise specified in one or more sections of the Site, no element of the Site may be copied, reproduced, distributed, published, translated, downloaded, displayed or transmitted in any way whatsoever, without the prior written permission of the Corporation.

The information contained on the Site, which is transmitted by candidates seeking employment, by employers seeking to fill a specific position within their organization, or by recruitment firms pursuant to specific mandates from employers in order to fill a position, may only be used for these sole purposes and by these sole persons. See the restrictions contained in the "Privacy and Personal Information Protection Policy" section found on this Site. No other use is permitted, nor is any user authorized to access the Site or use it, or benefit from the services offered there.

1.3 Material Transmitted by Users, as a Candidate, Employer or Recruitment Firm

You acknowledge, as a user of the Site, that all elements and information that you transmit:

You also grant the Corporation a non-exclusive and free license to display, translate, print and make any other use of this information for the purposes of operating and promoting the Site, recruiting candidates or offering services by potential employers. The license also includes the right for the Corporation to allow authorized users of the Site (candidates, employers and recruitment firms) to access the information you transmit to us, to use it and to print it for the sole purposes provided for on the Site.

The Corporation cannot, however, control access to the information, or their use, by any person other than an authorized user of the Site (candidates, employers and recruitment firms), or for the sole purposes authorized by the Site by these authorized users, and therefore cannot be held liable for any damages in this regard. See the "Limitation of Liability" section.

Furthermore, you are prohibited from transmitting to the Corporation elements and information that would be false, illegal, defamatory, obscene or contrary to any applicable law. By transmitting content elements to it, you represent to the Corporation that you have all rights to them, whatever they may be, notably intellectual property rights. The Corporation reserves the right not to publish or to withdraw any element that you have transmitted to it at its sole discretion, for any reason.

1.4 Account Cancellation (Candidate or Employer)

You must request the cancellation of your profile by addressing it either by email to Juricarrière Technical Support (soutien@juricarriere.com), or by mail to the Corporation de services du Barreau du Québec's coordinates.

Within 90 days following a cancellation request, the Corporation undertakes to delete all data relating to your User profile. In accordance with our "Privacy and Personal Information Protection Policy", non-nominal data that does not allow the identification of the persons to whom this data refers may be retained by the Corporation for statistical analysis purposes.

Upon request, we will make reasonable efforts to provide the owner of a Profile with a copy of the lawful and compliant content linked to it. You must make this request at the same time or before any request for cancellation and deletion of profile.

2. SECURITY AND PRIVACY

The Corporation is concerned with ensuring the protection of information transmitted via the Internet network as well as respecting your privacy. Thus, the Corporation informs you of its security measures, its policy on the nature of information collected about you when you order products through the Site, the reasons why this information is collected and the use made of this information, all on a separate page named "Privacy and Personal Information Protection Policy". The use of the Site entails acceptance by users of the terms set forth in the Corporation's "Privacy and Personal Information Protection Policy".

3. INTELLECTUAL PROPERTY

3.1 Copyright

The contents included in this Site are protected by various laws, notably those concerning copyright. Any reproduction, publication, translation, distribution, download, display, transmission, public performance or other infringement of the contents included in the Site, in part or in whole, other than what is specifically provided for and authorized, is strictly prohibited. Any unauthorized use of said contents could expose the offender to civil liability proceedings and/or criminal proceedings under common law or laws concerning intellectual property.

3.2 Trademarks

The trademarks and logos used or displayed on the Site are trademarks (registered or not) of the Corporation de services du Barreau du Québec and the Quebec Bar or third parties. Nothing in the Site should be interpreted in such a way as to allow, directly or indirectly, the use of a trademark reproduced on the Site without the prior written permission of the owner of such trademark.

4. LIMITATION OF LIABILITY

THE ELEMENTS AND INFORMATION CONTAINED IN THE SITE ARE PROVIDED AS IS, WITHOUT ANY WARRANTY, IMPLIED OR EXPRESS SUBJECT TO ANY PUBLIC ORDER LEGISLATION TO THE CONTRARY EFFECT. THE CORPORATION DISCLAIMS ALL LIABILITY AND GIVES NO WARRANTY, NOTABLY THE WARRANTIES OF QUALITY OR FITNESS FOR A PARTICULAR PURPOSE. FURTHERMORE, THE CORPORATION MAKES NO REPRESENTATION REGARDING THE USE, VALIDITY, ACCURACY OR RELIABILITY OF THE ELEMENTS AND INFORMATION REPRODUCED ON THE SITE OR REGARDING THE RESULTS ARISING FROM THE USE OF SUCH ELEMENTS OR INFORMATION. ALTHOUGH THE CORPORATION DOES EVERYTHING POSSIBLE TO ENSURE THAT THE SITE CONTAINS NO ERRORS, THE CORPORATION DISCLAIMS ALL LIABILITY REGARDING ANY ERROR THAT MAY BE FOUND ON THE SITE. THE CORPORATION, ITS ADMINISTRATORS, OFFICERS, EMPLOYEES, REPRESENTATIVES AND AGENTS CANNOT IN ANY CASE BE HELD LIABLE FOR ANY DAMAGE RELATED, DIRECTLY OR INDIRECTLY, TO THE USE OF THE SITE OR TO THE FOREGOING, WHATEVER THEY MAY BE.

MORE PARTICULARLY AND WITHOUT RESTRICTING THE GENERALITY OF THE FOREGOING, THE CORPORATION CANNOT ALSO CONTROL ACCESS TO THE ELEMENTS AND INFORMATION FOUND ON THE SITE, OR THEIR USE, BY ANY PERSON OTHER THAN AN AUTHORIZED USER OF THE SITE (CANDIDATES, EMPLOYERS AND RECRUITMENT FIRMS), OR FOR THE SOLE PURPOSES AUTHORIZED BY THE SITE BY THESE AUTHORIZED USERS.

THE CORPORATION ALSO DISCLAIMS ALL LIABILITY, BOTH TOWARDS A CANDIDATE, AN EMPLOYER OR A RECRUITMENT FIRM IN THE EVENT THAT A CURRICULUM VITAE IS TRANSMITTED BY ERROR.

IN THE EVENT THAT THE CORPORATION'S LIABILITY TOWARDS AN EMPLOYER OR A RECRUITMENT FIRM WERE RETAINED, NOTWITHSTANDING THE FOREGOING, IT WILL BE LIMITED TO A SUM OF MONEY EQUIVALENT TO THE PRICE PAID TO POST A POSITION.

IN THE EVENT THAT THE CORPORATION'S LIABILITY TOWARDS A CANDIDATE WERE RETAINED, NOTWITHSTANDING THE FOREGOING, IT WILL NOT BE SUBJECT TO MONETARY COMPENSATION.

The Corporation notably disclaims all liability in the event of interruption or suspension of the Juricarrière service, in the event of breakdown, force majeure or network problem.

The Corporation may terminate the Juricarrière service at any time and at its discretion, without refund of any monies that may have been paid to it.

The Corporation has no obligation to find a candidate for a position posted by an employer or a recruitment firm. Likewise, it assumes no obligation towards a candidate to find a position or employment for them.

The Corporation assumes no responsibility for information obtained on another site from a hyperlink found on the Juricarrière Site.

5. MODIFICATION OF TERMS

The Corporation reserves the right to modify at any time the terms and conditions of use of the Site. The modifications made will be in effect immediately after the terms are downloaded to the operating Site. Furthermore, the Corporation will not be responsible for the non-performance, in whole or in part, of any of its obligations, nor for damages or losses suffered, if the non-performance, damages or losses result from a case of force majeure or a circumstance beyond its control. No act of tolerance, with respect to a violation of a provision of these terms, on the part of a party, by its conduct or otherwise, will be interpreted as a waiver of the rights and/or privileges, by that party, provided for in any provision of these terms, unless a duly formal amendment is made in writing to this agreement.

6. APPLICABLE LAW

This agreement is governed by the applicable laws in the province of Quebec, Canada. Any dispute must be brought before a competent court sitting in the district of Montreal, Quebec, Canada, to the exclusion of any other court.
